The cell phone footage, released by CNN, of two construction workers at the scene early last month appears to support accounts by other witnesses that Brown was retreating or surrendering when he was shot by Ferguson police officer Darren Wilson, legal experts said on Friday.
The video shows one of the men raising his hands immediately after the fatal shooting and shouting, "He had his fuckin' hands up."

The Obama administration's chief spokesman confirmed on Friday that the United States is officially 'at war' with the self-proclaimed Islamic State of Iraq and al-Sham (ISIS, also called ISIL), the terror group that has become America's top military and foreign affairs priority.
White House Press Secretary Josh Earnest told reporters Friday during his daily press briefing that the battle against ISIS now mirrors the ongoing War on Terror closely enough to use the 'W' word.
'The fact is ISIL has indicated that they're ready to go to war against the world,' Earnest said, 'and this president – as is expected of American presidents – is stepping up to lead an international coalition to confront that threat and to deny ISIL a safe haven.

The CIA brought top al-Qaeda suspects close “to the point of death” by drowning them in water-filled baths during interrogation sessions in the years that followed the September 11 attacks, a security source has told The Telegraph.
The description of the torture meted out to at least two leading al-Qaeda suspects, including the alleged 9/11 mastermind Khalid Sheikh Mohammed, far exceeds the conventional understanding of waterboarding, or “simulated drowning” so far admitted by the CIA.
